Mercer Manchester Terms
Terms & Conditions
These Terms and Conditions ("Terms") apply to all purchases made through the Mercer Manchester website (the "Site"). They set out the basis on which we sell our products to you, along with your rights and responsibilities when ordering from us. Please read them carefully before placing an order.
If you have any questions about these Terms, you can contact us at info@mercermanchester.com.
1. Acceptance of These Terms
By placing an order through the Mercer Manchester website, you confirm that you have read, understood and accepted these Terms.
These Terms apply to all orders placed by consumers through our Site. If you do not agree with any part of these Terms, please do not place an order.
We may update or amend these Terms from time to time. The version that applies to your order is the one published on the Site at the time the order is placed.
2. Product Information
We take great care to describe our products accurately and to keep the information on our Site up to date. Even so, typographical errors, inaccuracies or omissions may occasionally occur, and we reserve the right to correct them.
Photographs, images and illustrations on the Site are provided for illustrative purposes. Slight variations in colour, texture or detail may occur due to screen settings, photography, and the natural characteristics of our materials.
Where a product is listed at an obviously incorrect price or with incorrect information due to a genuine error, we reserve the right to cancel the order, even after it has been confirmed, and to refund any amount already paid in full.
3. Pricing and Currency
All prices on the Site are displayed in pounds sterling (GBP) and include VAT, unless stated otherwise.
Prices are correct at the time of publication but may change without notice. Any change will not affect orders we have already confirmed.
4. Orders and Payment
Your order constitutes an offer to purchase. A contract between you and Mercer Manchester is formed only once we have accepted your order and received full payment.
Orders are processed after receipt of payment in full. The payment methods available are displayed during the checkout process.
We reserve the right to cancel or refuse any order in the event of a payment problem, a suspected fraudulent transaction, a pricing or product error, or where we are otherwise unable to fulfil the order. Where an order is cancelled by us after payment, any amount paid will be refunded in full.
5. Order Cancellation
You may request to cancel your order within 12 hours of placing it. To do so, please contact us as soon as possible at info@mercermanchester.com, quoting your order number. If your order has not yet been dispatched, we will cancel it and refund you in full.
After this period, your order may already be in processing or have been dispatched, and we can no longer guarantee that it can be stopped before it leaves us. In that case, you can still cancel by returning the goods once they arrive.
This does not affect your statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your order for any reason within 14 days of receiving your goods. Full details on how to return an item are set out in our Returns & Refunds Policy, and we will refund you within 14 days of receiving the goods back or of you providing proof of return, whichever is sooner.
6. Processing and Delivery
Orders are generally processed within 1 to 3 working days. The estimated delivery time is 5 to 10 working days. These timeframes are estimates and are not guaranteed.
Mercer Manchester cannot be held responsible for delays caused by carriers or other circumstances beyond our reasonable control.
It is your responsibility to provide accurate and complete delivery details at checkout. We are not responsible for parcels delayed, lost or returned to us as a result of an incorrect or incomplete address. Any error in your order details, including the delivery address, should be reported to us within 24 hours of placing the order.
7. Returns and Change of Mind
In addition to your statutory right to cancel, we offer a 30-day window from the date you receive your item during which you may request a return if you change your mind, subject to the conditions set out in our Returns & Refunds Policy.
Full details of how to return an item, the conditions that apply, return costs and refund timeframes are set out in our Returns & Refunds Policy, which is available on the Site and forms part of these Terms.
8. Your Statutory Rights
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If they are not, you are entitled to a remedy. Within 30 days of delivery you may reject faulty goods for a full refund; after that, you are entitled to a repair or replacement, and if that is not possible or does not resolve the fault, a price reduction or refund.
If you believe a product is faulty, damaged or not as described, please contact us at info@mercermanchester.com with your order number and supporting photographs, and we will work with you to provide an appropriate remedy. These rights are in addition to any voluntary returns we offer under our Returns & Refunds Policy.
9. Liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your statutory rights as a consumer.
We are not liable for delays or failures caused by events outside our reasonable control.
You remain responsible for the accuracy of the information you provide when placing an order, in particular the delivery address.
10. Complaints Procedure
We want you to be happy with your experience. If you have a complaint, please submit it in writing to info@mercermanchester.com, including your order number and a description of the issue.
We will endeavour to acknowledge and respond to complaints within 5 working days.
11. Privacy
Any personal information you provide when placing an order is handled in accordance with our Privacy Policy, available on the Site, and in line with UK data protection law, including the UK GDPR and the Data Protection Act 2018.
12. Intellectual Property
All content on the Site, including text, photographs, logos, graphics and design elements, is the property of Mercer Manchester or its licensors and is protected by applicable intellectual property laws. This content may not be copied, reproduced, distributed or used in any way without our prior written authorisation.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, our products, or applicable legal requirements. The updated version will be published on the Site and will apply to all orders placed after it is published.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue to apply in full.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. You may bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of your home nation. Nothing in these Terms affects your mandatory rights as a consumer.
